• Discover the Best Surrogacy in USA: A Complete Guide for Intended Parents

For many hopeful parents, surrogacy offers a life-changing path to building a family, especially in the United States, where advanced medical infrastructure, legal clarity, and access to world-renowned professionals make it a top destination. If you’ve ever wondered about the best surrogacy in USA, you’re not alone. Intended parents from all over the world—from Europe to Asia to the Middle East—seek U.S.-based programs for their safety, legal framework, and emotional support. This blog explores the surrogacy journey in the USA, comparing it to other legal surrogacy countries, analyzing costs, exploring inclusive options such as gay surrogacy USA, and highlighting what truly makes American agencies stand out. Why the USA Offers the Best Surrogacy Experience Globally? Which Country is Best for Surrogacy? Understanding the Global Landscape Globally, only a few countries offer a fully legal, ethical, and medically advanced surrogacy ecosystem. Countries like Ukraine, Georgia, and Colombia have become popular in the past, but political instability, legal ambiguity, and ethical concerns have raised red flags. On the other hand, the USA consistently ranks as the top answer to “which country is best for surrogacy?” Key reasons the U.S. surrogacy system is preferred: Legal protection for all parties High medical standards and fertility technology Freedom for LGBTQ+ and single parents Structured agencies with transparent processes Moreover, each state has its own legal framework, but several states like California, Nevada, and Oregon offer some of the most parent-friendly laws in the world. How Surrogacy Agencies in USA Support Intended Parents? Choosing a Surrogacy Agency US: What Makes a Good Match? Selecting the right surrogacy agency in the US is a vital part of the journey. Whether you’re a couple struggling with infertility, a single intended parent, or part of the LGBTQ+ community, American agencies offer unmatched flexibility and support. Top agencies offer: Pre-screened surrogate mothers Legal coordination for contracts and parental rights Access to fertility clinics and IVF centers Mental health counseling for both parties Tailored programs for international and gay surrogacy USA clients One of the standout features of the best surrogacy agencies is personalized case management, ensuring that every intended parent has a dedicated coordinator who guides them from embryo transfer to the baby’s delivery. Breaking Down Surrogacy Cost in USA Understanding the Full Picture of Surrogacy Cost USA The surrogacy cost in USA is often perceived as high, but for good reason. The pricing reflects the quality of medical care, legal safeguards, and surrogate support. On average, intended parents can expect to spend between $110,000 – $180,000, depending on several factors: Surrogate compensation (typically $40,000–$60,000) Fertility treatments and IVF ($25,000–$35,000) Legal fees ($8,000–$15,000) Agency fees and administrative support ($25,000–$50,000) Miscellaneous costs (insurance, travel, birth-related expenses) Agencies like MediPocket Surrogacy USA offer customized packages for international clients, allowing flexibility in payment schedules and value-added services like visa support, travel coordination, and translation assistance.   Inclusive Family Building: Gay Surrogacy USA and Single Parent Options Why the Best Surrogacy in USA Welcomes All Family Types? One of the defining strengths of American surrogacy is its inclusivity. Gay surrogacy USA is legal and widely practiced in states like California, New York, and Illinois. Many agencies proudly support same-sex male couples, lesbian couples, and trans individuals in their parenthood journeys. These agencies offer: Access to egg donor banks Supportive surrogates aligned with LGBTQ+ values Legal contracts that reflect both partners as legal parents Psychological counseling and community networking International LGBTQ+ parents are often amazed by the warmth and professionalism they receive in the U.S.—a stark contrast to more conservative countries where surrogacy is restricted or illegal. Legal Framework: Surrogacy Laws That Protect All Parties Understanding Surrogacy in the U.S. and Legal Surrogacy Countries Worldwide Surrogacy is a life-changing journey, not just medically and emotionally, but legally as well. Legal clarity is crucial to protect the rights of intended parents, surrogates, and the baby. While surrogacy is legal in many countries, the United States stands out for having some of the most well-defined and enforceable surrogacy laws, particularly in select states. This strong legal infrastructure is one of the reasons the U.S. remains a global leader for international surrogacy cases. Surrogacy in the USA: A State-by-State Legal Approach Unlike many countries that have nationwide laws governing reproductive rights, the USA governs surrogacy at the state level. This means the legality, enforceability of contracts, and the legal process to establish parentage all depend on the state where the surrogate resides or delivers. However, several states have created highly surrogacy-friendly environments. Here’s a closer look at some of the most favorable states for surrogacy: California: Known as the gold standard for surrogacy law. California allows gestational and traditional surrogacy for all family types—single, married, LGBTQ+, or heterosexual. Pre-birth orders are commonly granted here, meaning the intended parents’ names can be placed on the baby’s birth certificate before the child is even born. Courts and legal professionals are well-versed in handling international surrogacy cases. Nevada: Offers one of the most inclusive and secure legal frameworks. Its laws enforce surrogacy contracts regardless of the intended parents’ marital status or sexual orientation. This is particularly beneficial for international single fathers and LGBTQ+ couples who may face legal hurdles in their home countries. Connecticut: Provides full legal protection and streamlined pre-birth parentage orders, especially for same-sex and single parents. The legal procedures are efficient and handled by courts that regularly process surrogacy cases. Oregon: Though lacking specific surrogacy statutes, Oregon is still extremely favorable due to court precedent and administrative efficiency. Intended parents from any country can obtain pre-birth or post-birth orders with relative ease. These states combine progressive legislation with supportive medical and legal infrastructures, making them ideal hubs for cross-border surrogacy arrangements. Most intended parents working with MediPocket Surrogacy USA choose surrogates in these jurisdictions for smoother legal transitions. Legal Surrogacy Countries: A Global Perspective When looking beyond the United States, there are a handful of legal surrogacy countries that permit altruistic or compensated surrogacy under specific conditions. However, none match the comprehensiveness, legal enforceability, and medical access

Whether you’re a couple battling infertility, a single parent by choice, or a same-sex couple pursuing parenthood, working with the right agency can define your journey—legally, medically, and emotionally. Surrogacy has come a long way from being a niche solution to becoming a globally accepted path to parenthood. But with varying laws, costs, ethical concerns, and medical practices across countries, finding a top surrogacy agency that aligns with your values, timeline, and family goals is essential. In this article, we’ll break down the key factors that make a surrogacy agency trustworthy, explain the full process, and explore global best practices for every type of family. What Makes a Top Surrogacy Agency? Choosing a surrogacy agency is more than checking off a list—it’s about choosing trust, expertise, and transparency. Here’s what separates a top surrogacy agency from the rest: Legal, Medical & Ethical Transparency Top agencies offer a legally sound surrogacy process, matched with medically vetted surrogates and transparent contracts. They provide access to trusted legal professionals, doctors, and reproductive endocrinologists who work together to ensure compliance across borders. You should expect: Clear contracts outlining surrogate rights and intended parents’ responsibilities Medical screenings and psychological evaluations for surrogates Background checks, insurance guidance, and milestone-based planning Global Access and Surrogate Diversity Agencies with international capabilities are highly sought after. Many intended parents travel or reach out across borders for better healthcare, faster matching, and legal protections. Agencies like MediPocket Surrogacy USA offer immediate surrogate matching, embryo creation support, expert OB-GYN input, and concierge care, tailored for elite clients worldwide. Single Father Surrogacy & Solo Parenting Surrogacy isn’t just for couples. Increasingly, single father surrogacy is gaining legal and social momentum. Many single men—by choice or circumstance—wish to experience fatherhood and opt for gestational surrogacy with egg donors. Navigating Solo Fatherhood Through Surrogacy Top agencies provide: Specialized legal frameworks that support unmarried or single men Confidential matching with egg donors and surrogates High-touch concierge support from planning to post-birth Countries like the U.S. are more accommodating of single-parent surrogacy than others, offering legal protections that guarantee parentage before birth. How Much Does Surrogacy Cost? One of the most common questions is: How much does surrogacy cost? The answer varies dramatically depending on location, services, medical complexities, and legal requirements. Breaking Down Surrogacy Costs Across Countries In the USA, surrogacy can cost between $100,000 – $180,000, depending on services, surrogate compensation, IVF procedures, donor arrangements, and agency fees. However, working with a top surrogacy agency ensures that:   There are no hidden fees You receive premium medical and legal services You gain access to well-screened surrogates and faster matches By contrast, countries with fewer legal protections may offer surrogacy for less, but with significant ethical and legal risks. What Is Surrogacy Process: From Match to Baby For intended parents, understanding the surrogacy process is key to managing expectations and timelines.   Step-by-Step Guide to the Surrogacy Journey Initial Consultation – Understanding your goals and legal eligibility Matching – With a medically-screened surrogate and (if required) an egg donor Legal Clearance – Contracts, parental rights, and documentation Embryo Transfer – IVF and pregnancy tracking at certified fertility clinics Pregnancy Support – Monthly check-ins, insurance, nutrition, and psychological support Birth & Legal Finalization – Delivery and issuance of legal parentage documents Working with a top surrogacy agency ensures that each of these steps is handled professionally and compassionately, especially for international intended parents. Gay Surrogacy USA: Equality in Parenthood Same-sex couples, especially gay men, have found hope and equality through surrogacy in the United States. Gay surrogacy USA laws are among the most inclusive globally, particularly in states like California, Connecticut, and New York.   Creating Families with Dignity and Legal Safety Top agencies work with LGBTQ+ friendly lawyers, IVF clinics, and surrogates who understand the nuances and sensitivities of same-sex surrogacy. Support includes: Double-donor cycles (egg donor + gestational surrogate) Legal contracts assigning both partners as legal parents Inclusive maternity hospitals and post-birth assistance This makes the USA one of the safest and most progressive countries for gay surrogacy. Which Country Is Best for Surrogacy? The question of jurisdiction matters. Not all countries allow or regulate surrogacy equally. So, which country is best for surrogacy? The answer depends on your legal needs, budget, and personal preferences. Comparing Surrogacy-Friendly Countries   Country Legal for Foreigners LGBTQ+ Friendly Estimated Cost Match Time USA Yes Yes $100k–$180k 2–6 weeks Canada Yes Yes $80k–$120k 3–8 months Ukraine No (Foreigners now restricted) No $40k–$70k N/A Georgia  Yes (Hetero only) No $50k–$80k 1-2 Months Mexico Yes (Some states) Yes $60k–$90k 1-3 Months   The USA remains the most legally protected and medically advanced choice, particularly for high-profile clients, complex medical cases, and non-traditional families. Gender Preference and Legal Considerations One question that often arises is: who decides the gender of a baby in surrogacy? Ethics and Legality of Gender Selection In the USA, gender selection is legal in many states, but it must be conducted under ethical guidelines and with medical justification, such as avoiding gender-linked genetic diseases. The decision is typically made by: Intended Parents – if they opt for Preimplantation Genetic Testing (PGT) Doctors – who advise on ethical limitations Agency Guidelines – that regulate medical tourism and reproductive laws Not all countries allow this practice, which is why working with a top surrogacy agency in a jurisdiction like the U.S. is important. • Surrogacy USA: Your Complete Guide to Family-Building in America

When intended parents seek a safe, regulated, and ethical path to parenthood, Surrogacy USA stands out as a leading option. With clear legal frameworks, medically advanced clinics, and a commitment to family-centered care, the U.S. offers unmatched quality. But navigating surrogacy in USA can seem complex: what is surrogacy process? How does it differ from IVF? And what does “surrogate” truly mean? This detailed guide walks you through each stage—from definitions and legal protections to step-by-step logistics—so your journey to parenthood is confident, informed, and joyful. Understanding Surrogate Meaning and Roles in Surrogacy What Does Surrogate Mean in Today’s World? A surrogate is a person who carries a pregnancy for another individual or couple. In the context of Surrogacy USA, this almost always refers to gestational surrogacy, where the surrogate has no genetic link to the child. Unlike traditional surrogacy, the surrogate does not supply her own egg. Instead, an embryo is created via IVF using the intended parents’ (or donors’) eggs and sperm, and then transferred to the surrogate. This clear separation of roles—egg/sperm genetic parent vs. carrier—is critical for parental rights, medical safety, and ethical transparency.   Surrogacy in USA – Step-by-Step Process what is surrogacy process in America? In the U.S., surrogacy is understood best as a coordinated sequence: Consultation & Eligibility – Medical, psychological, and legal screening for intended parents and surrogates. Agreement & Identity Match – Intended parents outline preferences, the surrogate is selected, and legal contracts are drafted. IVF & Embryo Creation – Working with a fertility clinic, embryos are created from genetic parents. Transfer & Pregnancy – Embryo implanted into surrogate; pregnancy monitored through 1st & 2nd trimesters. Pre-Birth Orders – Courts issue legal parental rights to intended parents before delivery. Birth & Handover – Baby is born, legally transferred, and begins life with the intended parents. These steps are carefully regulated in Surrogacy USA to ensure the highest medical, legal, and emotional standards for everyone involved. How Surrogacy USA Differs from IVF Difference Between Surrogacy and IVF Explained While IVF (In Vitro Fertilization) is primarily a fertility treatment, surrogacy and IVF often work together, but they’re not the same. IVF refers to fertilizing eggs in a lab, then transferring embryos, usually to the person who will carry the pregnancy. Surrogacy uses IVF plus a third-party carrier. Legally and emotionally, surrogacy involves contracts, surrogates’ rights, and birth certificates that establish intended parents. The difference between the two comes down to who carries the baby and the significant legal framework wrapped around it.   Key Benefits of Choosing Surrogacy USA Why Surrogacy USA Is the Top Choice? Strong legal protections across many U.S. states Extensively screened surrogates, ensuring health and psychological stability Advanced fertility clinics offering high IVF success rates Pre-birth orders that secure parental rights without disruption Cross-border support services, backed by professional agencies Families choose Surrogacy USA for reliable, ethical, and efficient paths to parenthood, with peace of mind every step of the way. Choosing the Right Surrogacy Path How to Pick a Surrogacy Program in the USA? Identify reputable agencies with track records in international cases Confirm state laws: some states (like California) are more surrogacy-friendly Evaluate surrogate programs that handle medical screening, psychological evaluation, and ongoing support Request legal advice on pre-birth orders and parental rights recognition in your home country Compare total cost estimates, including compensation, medical care, legal fees, travel, and contingency funds Focusing on these factors helps you select a program that is legally secure, medically thorough, and internationally friendly. It includes surrogate matching, IVF, embryo transfer, pregnancy, legal pre-birth orders, and delivery. Each step is medically and legally monitored for safety. Q2: How does surrogate meaning affect parental rights? In gestational surrogacy, the surrogate has no biological connection. Legal contracts define intended parents as the baby’s legal parents before birth. Q3: What’s the difference between surrogacy and IVF? IVF creates embryos; surrogacy uses IVF plus a carrier. Surrogacy involves legal & emotional agreements for birth & parental rights. Q4: Is surrogacy USA legal for international couples? Yes, especially in surrogacy-friendly states like California. Agencies handle visas, travel, and documentation for international intended parents. Q5: How are surrogates medically screened? Surrogates undergo full health screenings: fertility tests, infectious disease checks, psychological assessments, and a healthy pregnancy history review. You’ll also get clarity on intended parents’ surrogacy agency USA vs. other international programs, plus practical tips to navigate the process with clarity and ease. Why Choose an International Surrogacy Agency Better Options Through Surrogate Services International Using surrogate services internationally means access to a wider pool of qualified surrogates — professionally screened, medically supported, and familiar with U.S. fertility protocols. Many countries lack the rigorous screening standards you find in the U.S., and connecting through an international surrogacy agency gives intended parents peace of mind while expanding their options. Legal & Ethical Assurance with Intended Parents Surrogacy Agency USA An intended parents’ surrogacy agency USA ensures your path is legally protected. In the U.S., gestational surrogacy is clearly regulated: contracts are enforceable, parental rights are assigned before birth, and legal parentage is strong. International parents must work with agencies that specialize in cross-border surrogacy and bridge the gap between different countries’ laws. Navigating International Surrogacy Programs Steps in International Surrogacy Programs Discover how international surrogacy programs unfold — from initial consultation through surrogate matching, IVF, pregnancy, legal coordination, travel, and post-birth procedures. Learn how to compare agencies, examine their success rates, and choose the best path for your family goals. In Surrogacy, Who Is the Biological Mother? (Informational) Clarify the often-asked question: in surrogacy, who is the biological mother — the surrogate or the intended mother? Explore gestational vs. traditional surrogacy, genetic parentage, legal definitions, and how U.S. agencies handle biological identity in contracts and birth certificates. Choosing the Right International Surrogacy Agency Top Evaluation Criteria for Agencies Look at agency policies, accreditation, surrogate screening, communication standards, success rates, and legal protections. Learn how to vet references and ask the right questions before committing. Hidden Costs & Financial Transparency Beyond medical fees, review administrative costs, surrogate compensation norms, travel expenses, legal fees, and contingency plans. International agencies should provide clear, itemized financial breakdowns. FAQ Section 1. What is the difference between an international surrogacy agency and local programs? An international surrogacy agency provides cross-border services for intended parents who seek to pursue surrogacy outside their home country, often in countries like the U.S., where surrogacy laws are robust and medically advanced care is accessible.  Unlike local programs, international agencies offer full legal, medical, and logistical support, including visa guidance, translation services, surrogate matching across borders, and coordination with fertility clinics. This is especially helpful for couples in countries where surrogacy is restricted or unregulated.   2. How does Surrogate Services International manage the medical screening of surrogates? Surrogate Services International follows strict U.S.-based medical protocols for screening potential surrogates. This includes: Comprehensive health evaluations (including gynecological, infectious disease, and fertility testing) Psychological assessments to ensure emotional readiness Background checks and lifestyle evaluations Review of prior pregnancy and delivery history These rigorous checks help ensure that only healthy, emotionally stable, and qualified surrogates are matched with intended parents, especially in medically complex cases such as IVF or embryo transfer. 3. Are the intended parents’ surrogacy agency USA contracts legally binding across borders? Intended parents’ surrogacy agency USA contracts are legally binding within the United States, especially in surrogacy-friendly states like California or Nevada. However, recognition of these contracts in your home country depends on local laws.  That’s why it’s essential to work with a legal team that specializes in cross-border reproductive law. A good international surrogacy agency ensures all necessary documentation, including birth certificates and parental rights, aligns with both U.S. and home-country requirements. 4. Who is legally the mother in surrogacy — surrogate or intended parent? In gestational surrogacy (the most common type today), the surrogate has no biological connection to the child, and the intended mother (or egg donor) is considered the biological or legal parent. Legally, parentage is established through pre-birth or post-birth court orders, depending on the state. Once those are finalized, the intended parents’ names are placed on the baby’s birth certificate, not the surrogate’s. This legal clarity is one of the key reasons families prefer to work with a licensed international surrogacy agency based in the U.S. 5. Can we start surrogacy in the U.S. and complete it in our home country? Yes, many families begin their journey with a U.S.-based international surrogacy agency and return home after the baby is born and legal documents are issued. Agencies like MediPocket Surrogacy USA help with: Obtaining U.S. birth certificates Applying for the baby’s passport Ensuring parentage is legally recognized at home Coordinating with immigration authorities and embassies This cross-border support ensures a smooth transition from the U.S. to your home country — whether you’re from Japan, the UAE, India, or Europe. Summary International surrogacy provides a reliable route to parenthood when guided by a reputable international surrogacy agency. With standards for surrogate medical screening, legal protections for intended parents, and clarity on biology and parentage, families can confidently build the future they’ve always dreamed of — no matter where they live. Is Surrogacy becoming popular in India?

Is there a boost in the Surrogacy process in Delhi due to high demand? You heard that right!! Many Couples are hopeful after LG gives a nod to the formation of Medical Boards in all Delhi districts to discuss the matter about Surrogacy Act. This happened after many couples filed a petition to make the Surrogacy process more accessible to them. ‘Many couples were nudging us over why Surrogacy was not happening in Delhi. Some require it due to recurrent abortions while some have heart diseases or neurological diseases” Quoted Dr. Gauri Agarwal, founder of seeds of innocence, an IVF center. This suggests that people in India are finally getting the message that surrogacy is a useful and brilliant method of growing or starting a family. This situation among Intended Parents in Delhi raises questions in the minds of other Indians. Is surrogacy becoming more popular in India? Well, we have the answer to that.  As the days and years go by, people are starting to accept the reality and process of Surrogacy rather than just sticking to the old traditional method of Reproduction. For those people who ask the reasons for such character development amongst people, here they are: Benefits of Surrogacy:   Surrogacy can benefit all parties involved, including intended parents, surrogates, and the child, for a variety of reasons. Here’s an explanation of why surrogacy can be beneficial to everyone: For Intended Parents. Parenthood Fulfilment: Surrogacy provides hope and a path to parenthood for individuals or couples who are having difficulty conceiving or carrying a pregnancy. It enables them to have a biological child and enjoy the benefits of parenthood. Genetic Connection: There is a genetic link between the intended parents and the child in cases of gestational surrogacy where the intended parents’ genetic material is used. This link is significant for many prospective parents. Involvement & Control: Intended parents have control over the prenatal environment and can participate actively in the pregnancy journey. They have the ability to attend prenatal appointments, make medical decisions, and bond with the surrogate. Legal Recognition: Surrogacy arrangements are legally recognized in many countries, ensuring that the intended parents have legal parental rights from birth, reducing the risk of legal complications. Surrogate Mothers: Empowerment: Surrogates frequently choose to become surrogates in order to help others and make a positive difference in their lives. It can be an empowering experience for them to help individuals or couples realise their parental dreams. Financial Compensation: Surrogacy can provide financial compensation to surrogates, which can be beneficial to their families and personal goals.  Medical Care: Surrogates receive comprehensive medical care and attention during surrogacy, ensuring their health and well-being throughout the pregnancy. Regular check-ups and prenatal care are required as part of the procedure. Supportive Community: Surrogates frequently become a part of a supportive community of other surrogates and intended parents. Emotionally, this sense of belonging and shared purpose can be gratifying. For the Child: Healthy Birth: Surrogacy enables a healthy and monitored prenatal environment, which contributes to the child’s well-being and ensures that they are born under optimal conditions. Loving Home: Individuals or couples who are fully prepared and eager to provide a loving and stable home for the child can use surrogacy. Genetic Connection: In cases of gestational surrogacy, the child has a genetic link to the intended parents, which can be important for their identity and sense of belonging. Concerning Society: Family Diversity: Surrogacy promotes family diversity and inclusivity, recognizing that families can be formed in a variety of ways. It recognizes and respects the choices made by individuals and couples when starting families. Surrogacy – The History and it’s Growth

Surrogacy has been practised since the ancient times of Abraham and Sarah, according to several academics. When Sarah was unable to conceive naturally, she enlisted the help of her handmaiden, Hagar, to carry her and Abraham’s child. According to Hindu legend, Balram, Devaki and Vasudev’s seventh child, was born in the womb of Rohini (Vasudev’s first child) to protect the infant from being slain by Devaki’s brother Kamsa. Since then, the term “surrogacy” has become commonplace. Yet, in many nations, the practice is either prohibited or frowned upon. Many individuals are uninformed of the surrogacy’s evolution and the timing of events. History of surrogacy The first successful surrogacy – 1970’s In the United States, the first successful surrogacy arrangement happened in 1976. Elizabeth Kane, the surrogate mother, bore a child for a couple who were unable to conceive owing to a medical problem. The infant was created by artificial insemination with sperm from the intended father and an egg from a donor. This surrogacy arrangement was revolutionary at the time since it demonstrated that a woman could bear a pregnancy on behalf of someone else. It offered up new options for couples dealing with infertility or other reproductive issues. With this achievement, surrogacy drew more attention and interest from couples looking for alternate means of family formation. Unfortunately, the legal and ethical difficulties surrounding surrogacy were not entirely resolved at the time, and was still a controversial practice for a long time. The first legal traditional surrogacy agreement – 1980 The first reported incidence of conventional surrogacy under a formal arrangement occurred in 1980 in Michigan, USA. The arrangement was between a married couple who were unable to create a child owing to the wife’s medical condition and the wife’s sister, who acted as a surrogate and conceived a kid using her own eggs. The couple and the surrogate signed a legal agreement outlining the details of the surrogacy relationship, including the surrogate’s compensation and obligations, as well as the intended parents’ rights and responsibilities. The agreement also addressed custody, visitation, and medical care problems. This legal surrogacy agreement established an important precedent for the practice of surrogacy by demonstrating that a surrogacy arrangement may be carried out under explicit and legally enforceable conditions. Yet, it highlighted ethical and legal concerns regarding using a surrogate’s own eggs, as well as the possibility of surrogate abuse or coercion. Surrogacy laws and regulations have developed since then to address some of these issues, and gestational surrogacy (in which the surrogate carries an embryo made using the intended parents’ or donors’ eggs and sperm) has grown in popularity. Yet, the legal and ethical concerns surrounding surrogacy remain complicated and contentious, and vary greatly between countries. The Baby M case- 1986 The Baby M case was a historic court case in the United States in 1986 involving a failed surrogacy agreement. The case included a couple, William and Elizabeth Stern, who were unable to conceive a child owing to Elizabeth’s medical condition. They engaged into a surrogacy deal with Mary Beth Whitehead, who consented to bear a child using her own eggs and William Stern’s sperm. The surrogacy pact was informal, with no attorneys or legal contracts involved. Once Baby M was born, Whitehead refused to give up custody, claiming she had changed her mind about the agreement. The case proceeded to court, and a protracted legal struggle developed over custody and other issues. The case presented a number of complicated legal and ethical concerns regarding surrogacy, including whether surrogacy agreements should be legally enforced and whether it was preferable for the kid to be reared by its original mother or by the intended parents. In the end, the Sterns won the case, and Baby M was put in their custody. The case had a significant influence on surrogacy legislation in the United States, resulting in the adoption of clearer legal norms and laws governing surrogacy arrangements. The first legal compensated surrogacy arrangement- 1980 The first compensated surrogacy deal was made in the United States in 1980, and a woman named “Elizabeth Kane” became the first compensated surrogate mother. She earned $10,000 for a successful and healthy birth. This first compensated surrogacy arrangement took place without a legal agreement, resulting in legal challenges and controversy over topics such child custody and parental rights. But, it also established a significant precedent for the practice of surrogacy, proving that surrogates may be compensated for their services and opening up a new path for infertile couples to have a child. The first successful gestational surrogacy-1985 The first successful gestational surrogacy occurred in the United States in 1985. The method involved implanting an embryo generated using the intended parents’ eggs and sperm into the uterus of a surrogate mother who was not genetically linked to the kid. According to the Disease control and prevention, over 18,000 infants were born between 1999 to 2013. The successful delivery of a healthy kid via gestational surrogacy was an important milestone in the area of reproductive technology because it indicated that couples who were unable to conceive normally may have a genetically related child via surrogacy. Since the first successful gestational surrogacy, the technique has grown in popularity and acceptance across the world. However, the legal and ethical issues surrounding surrogacy remain complicated. Johnson V Calvert case- 1990 Johnson v. The Calvert case was a landmark legal case in the United States that helped to establish the legal rights of gestational surrogate mothers and intended parents. The case went on from 1990-1993 A surrogacy agreement between a married couple, Mark and Crispina Calvert, and a surrogate mother, Anna Johnson, was at the heart of the case. Due to medical concerns, the Calverts were unable to produce a child and got into a surrogacy agreement with Johnson, who became pregnant with an embryo generated using the Calverts’ eggs and sperm. Notwithstanding the conditions of the surrogacy arrangement, Johnson felt emotionally connected to the unborn child throughout the pregnancy and decided she wanted
